Sameday Shifts Terms of Service

Operating Area: Sameday Shifts currently operates exclusively in Washington, D.C. and Maryland. All guards must hold a valid security license issued by the state in which they work. Users outside these states may submit a request to bring Sameday Shifts to their area.

SameDayShifts is NOT a staffing agency, employer, or labor contractor. We are a technology platform that facilitates connections between independent parties.

SameDayShifts does not employ Guards. Guards are independent contractors who use our platform to find and accept work opportunities.

SameDayShifts does not guarantee the availability of shifts, work opportunities, or any minimum income to any Guard.

SameDayShifts does not guarantee that Employers will find qualified Guards for every shift posted.

All agreements for services are made directly between Guards and Employers through the platform.

You are an independent contractor, not an employee, agent, partner, or joint venture of Sameday Shifts.

You are solely responsible for all federal, state, and local taxes on compensation received through the platform, including self-employment taxes. Sameday Shifts will issue a 1099-NEC to Guards earning $600 or more in a calendar year.

You must submit a completed W-9 form and understand your 1099-NEC reporting obligations before receiving payment.

You are responsible for maintaining your own insurance, including general liability and any other insurance appropriate for your work.

Sameday Shifts provides no workers' compensation coverage for Guards. You are solely responsible for any work-related injuries sustained during a shift.

You must hold a valid, current state-issued security license for every jurisdiction in which you accept work at all times.

You are responsible for your own equipment, transportation, and any other tools necessary to perform security services.

You may work for other platforms, companies, or clients simultaneously, consistent with any Employer-specific requirements disclosed at booking.

You retain the right to accept or reject any shift offered, and Sameday Shifts retains the right to remove listings at any time.

Be at least 18 years of age.

Possess a valid, government-issued photo ID.

Guards must hold a valid security license issued by Washington, D.C. or Maryland (the states in which Sameday Shifts currently operates).

Provide accurate, complete, and current information during registration and at all times during your use of the platform.

Employers must be legally authorized businesses operating in compliance with all applicable laws.

Sameday Shifts charges Employers a service fee on top of the Guard's agreed hourly rate. This fee covers platform operations, payment processing, background checks, and license verification services.

Guards receive their agreed hourly rate for completed, verified shifts, minus applicable payment processing fees charged by our payment processor (Stripe).

Payments are processed via Stripe and may take 2–5 business days to appear in your connected bank account after a shift is completed and verified.

Sameday Shifts reserves the right to modify its fee structure upon 30 days' written notice to affected users.

Sameday Shifts is not responsible for payment delays caused by third-party payment processors, banking institutions, or errors in payment information provided by users.

Guards are responsible for ensuring their Stripe Connect account is properly configured to receive payouts. Unclaimed payments may be subject to Stripe's dormant account policies.

Licensed Security Work Only: This platform is for licensed security professionals performing lawful security duties only. Posting or accepting any shift that involves unlawful activity is strictly prohibited.

Non-Solicitation: You agree not to solicit, hire, or work with any guard/employer discovered through SameDayShifts outside of the platform for a period of 12 months after your last platform interaction. Violation results in immediate account suspension and may result in legal action.

Fraudulent clock-ins or clock-outs, including clocking in remotely when not physically present at the shift location.

No-shows without canceling a confirmed shift at least 4 hours before the scheduled start time.

Harassment, discrimination, or abusive behavior toward any other platform user, Employer, or Sameday Shifts personnel.

Misrepresentation of qualifications, licenses, certifications, identity, or any material information.

Circumventing the platform to arrange payment or services directly with another user outside of the SameDayShifts platform, for any work connected to the platform.

Chargeback Defense: Frivolous chargebacks for completed shifts with verified attendance (GPS-stamped clock-in/out) result in immediate account suspension. Clock-in/out timestamps with GPS coordinates serve as the authoritative record in any dispute.

Attempting to scrape, reverse-engineer, or interfere with the platform's systems, data, or infrastructure.

Sharing account credentials with any third party.

Any conduct that violates applicable local, state, or federal law.

Arbitration shall take place in Washington, D.C., unless the claim is for $10,000 or less, in which case the arbitration may be conducted by telephone, online, or at a mutually agreed location.

Small claims court is available for qualifying disputes within that court's jurisdictional limits.

This arbitration clause survives any termination of your agreement with Sameday Shifts.

Sameday Shifts' total cumulative liability to you for any claims arising from your use of the platform is capped at the greater of: (a) $100.00 USD, or (b) the total fees you paid to Sameday Shifts in the 12 months immediately preceding the claim.

Sameday Shifts is NOT liable for: Guard misconduct, negligence, or criminal acts on job sites; Employer non-payment for services arranged outside the platform; personal injury, illness, or death occurring during a shift; lost wages due to shift cancellation by any party; data breaches caused by third-party services including Stripe or other vendors.

Sameday Shifts makes no warranties about the accuracy of Guard qualifications beyond license number verification. Employers are responsible for conducting their own due diligence.

The platform is provided "as-is" and "as available" without any warranty of uptime, reliability, accuracy, or fitness for a particular purpose.

IN NO EVENT SHALL SAMEDAY SHIFTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Your use of, or inability to use, the platform.

Your violation of these Terms of Service.

Your violation of any applicable law, regulation, or rights of a third party.

Any services you perform or fail to perform as a Guard.

Any content or information you submit, post, or transmit through the platform.

All platform content, branding, trademarks, logos, technology, source code, and materials are the exclusive intellectual property of Sameday Shifts or its licensors and are protected by applicable intellectual property laws.

Users grant Sameday Shifts a non-exclusive, royalty-free, worldwide license to use, display, and process their profile information, reviews, and submitted content solely for the purpose of operating and improving the platform.

You may not reproduce, distribute, modify, create derivative works from, publicly display, reverse-engineer, or scrape any part of the platform without prior written consent from Sameday Shifts.

Sameday Shifts reserves the right to suspend or permanently terminate any user account at any time, with or without prior notice, for violations of these Terms, fraudulent activity, or for any other reason at our sole discretion.

Upon termination, your right to access the platform immediately ceases. Pending payments for completed, verified shifts will be processed in accordance with our standard payout schedule.

Users may request account closure at any time by contacting info@samedayshifts.com. Account closure does not entitle users to any refund of fees paid.

Sections 7, 8, 9, 10, and 12 of these Terms survive termination of your account.

Sameday Shifts uses artificial intelligence (AI) tools to assist with shift recommendations, matching Guards with suitable positions, and reviewing uploaded documents for completeness.

AI does NOT make final hiring or booking decisions. All shift bookings are initiated by the Guard and accepted by the Employer. No employment decision is made solely by automated means.

AI-assisted tools may flag uploaded documents for human review. Human review is available upon request by contacting info@samedayshifts.com.

You may request human review of any AI-assisted decision or recommendation by contacting info@samedayshifts.com.

Sameday Shifts complies with applicable federal and state automated decision-making disclosure laws, including where applicable, the Illinois AI Video Interview Act and similar state statutes.

These Terms of Service are governed by and construed in accordance with the laws of Washington, D.C., without regard to its conflict of law principles.

Federal law applies where applicable, including without limitation the Electronic Signatures in Global and National Commerce Act (E-SIGN) and the California Consumer Privacy Act (CCPA).

Sameday Shifts reserves the right to modify these Terms of Service at any time.

Material changes will be communicated to users via email to the address on file at least 14 days before the changes take effect.

Your continued use of the platform after the effective date of any modification constitutes your acceptance of the revised terms.

If you do not agree to the revised terms, you must cease using the platform and may close your account.
